USER CONTENT SUBMISSION TERMS

By submitting this content, you grant to Baseball For All and its affiliates, licensees, successors, and assigns (collectively, "Licensee") an unlimited, perpetual, royalty-free right to reproduce, publish, display, distribute, and otherwise use the photograph(s) and/or video(s) you submit (the "Your Content"), together with your name, image, likeness, statements, and user name (your "Likeness"), in whole or in part, whether or not modified in character or form, on Baseball For All's website(s), including the Hall of Baseballs for All section, and for any other legal purpose, including advertising, publicity, and marketing.

By submitting Your Content, you represent and warrant that: (a) you are the owner of Your Content and have full rights thereto, including all copyright rights, and the Licensee's use of Your Content and your Likeness will not violate or infringe upon the rights of any third party; (b) to the extent any other individual's image, likeness, or recognizable features appear in Your Content, you have obtained all necessary consents and releases from such individuals permitting the Licensee to use their images and likenesses in connection with Your Content; and (c) no additional permissions, consents, releases, or approvals from any third party are required for the Licensee to exercise the rights granted herein.

You release, hold harmless, and agree not to assert any claim against the Licensee arising from the exercise of the rights granted herein, including any claim of copyright infringement, invasion of privacy, or right of publicity, and you agree to indemnify and defend the Licensee against any claims arising from your breach of the foregoing representations and warranties. These terms are governed by the laws of the State of Georgia, without regard to conflicts of laws principles, and the State of Georgia shall be the exclusive venue for any disputes arising hereunder.
